Terms of Use for SubTracker
Preamble
These Terms of Use govern the use of the SubTracker application, provided by Innopulse Consulting GmbH, Gotthardstrasse 30, 6300 Zug, Switzerland. By using our services, you agree to these terms. These Terms are subject to the General Data Protection Regulation (GDPR) and the Swiss Federal Data Protection Act (DSG). They apply to all digital services provided by SubTracker, including mobile apps and other platforms.
- Definitions
- Service: The features and services provided by SubTracker.
- User: Any natural or legal person who uses the SubTracker services.
- Content: All data, texts, files, and information uploaded or generated by users.
- Data: All information collected, processed, and stored during the use of SubTracker.
- Contract: The agreement between the user and SubTracker regarding the use of the services.
- Subscription: The paid or free usage model for SubTracker’s services.
- Paid Services: All services that require payment.
- Contracting Party: Natural or legal persons who have entered into a contract with SubTracker.
- Lifetime Subscription: A one-time payment plan granting indefinite access to SubTracker’s core services, valid for the lifetime of the product or user account.

- Scope of Services and Subject Matter
The SubTracker application includes the following core features:
- Dashboard: Overview of all activities and notifications
- Subscription Management: Manual tracking and management of subscriptions
- Notification System: Creation and management of reminders
- Analytics Dashboard: Visualization of expenses and optimization suggestions
- Company Module: Tools for managing subscriptions at the organizational level
- Calendar Integrations: Google Calendar, Apple Calendar, Microsoft Calendar
- Support: Access to help documents and support contact
- Service Level Agreements (SLAs): Details on service availability and performance
- Limitations and Downtimes: Notices on service limitations or interruptions
- Registration and Account
- Registration: Users must register to use SubTracker’s services. Registration requires personal data such as name, email, and password.
- Account Management: Users can manage personal data, language, and currency settings, change passwords, and enable two-factor authentication (2FA).
- Account Deletion: Users may delete their account at any time. All stored data will be permanently deleted.
- Obligation to Provide Accurate Information: Users must provide truthful and complete information when registering and using their account.
- Update Obligation: Users must keep their information up to date.
- Account Suspension: SubTracker reserves the right to suspend or terminate accounts in case of violations of these Terms.
- Account Restoration: Accounts may be restored under specific conditions after suspension.
- Data Protection
Protecting your personal data is important to us. Please refer to our Privacy Policy for full details on how your data is processed and protected. This also includes third-party integrations such as Google Drive, Dropbox, etc.
- Data Retention and Deletion: Personal data is only stored for as long as necessary to fulfill the purpose of its processing or to comply with legal retention requirements. Afterwards, the data will be securely deleted. Data is stored in Switzerland or in countries with adequate data protection laws.
5.1 Legal Basis for Data Processing
SubTracker processes personal data in accordance with the General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (DSG), based on the following legal grounds:
- Consent: When users have given explicit consent for one or more specific purposes.
- Contractual Necessity: When processing is required to fulfill our obligations under the user agreement, such as providing access to the SubTracker service.
- Legal Obligation: When processing is necessary for compliance with legal or regulatory requirements.
- Legitimate Interest: When processing is necessary for our legitimate interests (e.g., improving our services, ensuring system security), provided such interests are not overridden by the user’s fundamental rights and freedoms.
5.2 User Rights
In accordance with the GDPR and DSG, users have the following rights with respect to their personal data:
- Right of Access: To request access to the personal data we hold about you.
- Right to Rectification: To request correction of inaccurate or incomplete data.
- Right to Erasure: To request deletion of your data (“right to be forgotten”) where legally permitted.
- Right to Restriction: To restrict how we process your data under certain circumstances.
- Right to Data Portability: To receive your data in a structured, commonly used format and have it transferred to another controller.
- Right to Object: To object to processing based on legitimate interests or direct marketing.
- Right to Withdraw Consent: To withdraw previously given consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
To exercise any of these rights, users may contact us at in**@********er.io. We will respond within the timeframes required by law.
Users also have the right to lodge a complaint with a supervisory authority, such as the Swiss Federal Data Protection and Information Commissioner (FDPIC) or a competent EU data protection authority.
- Payments
Payments are processed through Stripe, as well as Apple Pay and Google Pay. Stripe is a secure payment provider. More information can be found in the Stripe Privacy Policy.
- Payment Methods: Accepted methods include credit cards, debit cards, and other Stripe-supported methods.
- Billing Periods and Cycles: Users can choose between monthly and annual billing.
- Refunds: Details about refunds and how to dispute charges are outlined in our Refund Policy.
- Reminders and Late Fees: Information on reminders and late payment penalties.
- Chargebacks and Subscription Changes: How chargebacks and subscription modifications are handled.
- Term and Termination of Contract
- Monthly and Annual Subscriptions: SubTracker services can be subscribed to on a monthly or yearly basis. The billing period starts upon subscription activation.
- Notice Periods and Termination Procedures:
- Monthly Subscriptions: Can be cancelled at any time with 7 days’ notice before the current billing cycle ends.
- Annual Subscriptions: Can be cancelled at any time with 30 days’ notice before the current billing cycle ends.
- Lifetime Subscriptions: Cannot be cancelled.
Cancellation Process
Users may cancel their subscription via the “Account Settings” in their profile or by emailing in**@********er.io. A confirmation will be sent to the registered email after cancellation.
Early Termination
No refunds are provided for early termination of annual subscriptions. Exceptions may be made in cases of proven severe circumstances that make further use of the service impossible. Users can request a partial refund, which SubTracker will evaluate individually.
Renewals
- Automatic Renewal: Unless cancelled, subscriptions automatically renew for the selected period (monthly or yearly). Users will be notified 14 days before renewal by email.
- Plan Changes: Users can change between monthly and annual plans at any time. Changes take effect at the start of the next billing cycle.
Termination by SubTracker
SubTracker reserves the right to terminate subscriptions for the following reasons:
- Breach of Terms: Including unauthorized use or abuse of the services.
- Non-payment: Despite reminders.
- Legal or Regulatory Issues: That make it impossible to continue service. In such cases, the user will be notified by email and access will be immediately revoked. Prepaid fees will not be refunded.
Lifetime Subscription Disclaimer
A lifetime subscription to SubTracker refers to a one-time payment granting the user access to SubTracker’s core features for as long as the service is actively maintained and operated by Innopulse Consulting GmbH or its legal successors.
This subscription:
- Does not guarantee service availability for the user’s lifetime.
- Does not guarantee availability for any fixed number of years.
- Remains valid only while SubTracker is an actively supported product, or until the account is terminated in line with these Terms.
SubTracker may discontinue the lifetime plan or the entire product for legal, technical, or business reasons. In such cases, users will be notified at least 12 months in advance, unless earlier discontinuation is required due to circumstances beyond the company’s control.
Refunds for lifetime subscriptions are not provided, unless required by law or under exceptional cases explicitly reviewed and approved by Innopulse Consulting GmbH.
Terms of Use for SubTracker (Innopulse Consulting GmbH)
- User Responsibilities
- Security of Login Credentials: Users are responsible for keeping their login credentials (e.g., username and password) secure and confidential. They must not share these credentials with third parties. In case of suspected unauthorized account use, users must notify SubTracker immediately. Users are responsible for all activities carried out under their account.
- Compliance with Laws: Users must not use SubTracker services for illegal or unauthorized purposes. They must ensure that their use complies with all applicable local, national, and international laws and regulations, especially regarding data protection.
- Content Responsibility: Users are responsible for all content they upload, share, or modify. Uploading illegal, offensive, defamatory, or otherwise inappropriate content is prohibited. SubTracker reserves the right to remove such content and block user access.
- Prohibition of Automated or Scraping Tools: Use of automation or scraping tools that automatically access the service or extract data is strictly prohibited. Such tools may affect service performance and security. Violations may lead to account suspension without prior notice.
- Export Laws and Sanctions Compliance: Users must comply with all applicable export control laws and sanctions, including not exporting services or technology to sanctioned individuals or regions.
- Prohibited Disruptive Activities: Users must not use the service for disruptive actions such as denial-of-service attacks, spam, hacking attempts, or any activity that impairs service use by others. Violations may lead to account termination and legal action.
- Warranty and Liability
Innopulse Consulting GmbH assumes no liability for direct or indirect damages resulting from the use of the SubTracker application, unless such damages are caused by gross negligence or willful misconduct.
- Disclaimer of Liability: SubTracker and Innopulse Consulting GmbH are not liable for damages resulting from the use or inability to use the service, including data loss, lost profits, or business interruptions, as permitted by law.
- Indirect Damages: Liability for indirect damages, including lost profits or intangible losses, is excluded unless caused by gross negligence or intent.
- User Liability: Users are responsible for all damages resulting from misuse of the services, including those caused to third parties.
- Third-Party Liability: SubTracker is not responsible for third-party services or content linked through the platform. Users use such services at their own risk.
- Force Majeure: SubTracker is not liable for delays or service outages caused by events beyond its control, such as natural disasters, war, terrorism, regulatory changes, or pandemics.
- Changes to Services and Terms
Innopulse Consulting GmbH reserves the right to change these Terms of Use at any time. Users will be notified of significant changes and must accept them to continue using the service.
- User Notification: Changes will be communicated via email and/or notice on the website. Changes take effect 30 days after notice. Users may cancel their contract before changes become effective.
- User Rights for Significant Changes: In the event of significant changes, users may cancel the contract without notice. Any prepaid fees for the current billing cycle will be refunded proportionally.

Support Process:
- Initial Inquiry: Submitted via form, email, or phone and entered into our ticket system.
- Response Time: Initial response guaranteed within 24 hours on business days.
- Processing: Requests are prioritized by urgency and forwarded to relevant departments.
- Escalation: If unresolved, escalated to higher support levels. Users will be informed.
- Availability: Support is available Mon–Fri, 9:00–18:00 CET. Critical issues may be addressed outside these hours.
- Calendar Synchronization
SubTracker allows synchronization of deadlines and contract expirations with calendars to keep users organized.
- Google Calendar: Auto-sync of events and reminders. See Google’s privacy policy.
- Apple Calendar: Auto-sync of events and reminders. See Apple’s privacy policy.
- Microsoft Calendar: Auto-sync of events and reminders. See Microsoft’s privacy policy.
- Data Handling: Only data related to deadlines and reminders is synced and stored securely.
- Data Encryption: All data is encrypted during transmission and storage.
- Conflict Resolution: In case of sync conflicts, users will be notified and can choose the preferred version.
- Usage Data and Analytics
- Google Analytics: Used to analyze website usage. See Google Analytics privacy policy.
- Squarespace Analytics: Default tool collecting cookie-based user data.
- Data Types: Includes visited pages, clicks, session duration, device types, etc.
- Anonymization: All data is anonymized and aggregated to protect user privacy.
- Opt-Out Options: Users can disable tracking via browser settings or app preferences. See cookie policy.
- Customer Service and Feedback
- Channels: Available via email, phone, and ticket system.
- Response Times: First reply guaranteed within 24h on business days.
- Feedback & Complaints: Submitted via support system. Processed within 5 business days.
- App Changes and Updates
Innopulse Consulting GmbH reserves the right to modify SubTracker features or design at any time for improvements or legal reasons.
- Legal Compliance: Changes due to laws or security needs may be made without prior notice.
- Maintenance Windows: Scheduled maintenance is announced 48h in advance.
- Feedback Loop: Users may submit feedback on new features via the support system.
- Governing Law and Jurisdiction
These Terms of Use are governed by Swiss law. Place of jurisdiction is Zug, Switzerland.
- EU Consumer Exception: EU consumers may be subject to local consumer protection laws.
- Alternative Dispute Resolution: Users may opt for mediation or arbitration.
- Miscellaneous
- Severability: If any provision is invalid, the rest remain in effect.
- No Waiver: Failure to enforce a provision is not a waiver.
- Precedence: These Terms override previous agreements.
- Subsidiary Applicability: These Terms also apply to SubTracker’s affiliates.
- Security
- Security Audits: Regular security checks and penetration tests are conducted.
- Incident Reporting: Users must report suspected breaches or unauthorized access immediately.
- User Responsibility: Users must secure their devices and credentials.
- Intellectual Property
- Ownership: All rights to software, content, and services belong to SubTracker or its licensors.
- Usage Restrictions: No reproduction, distribution, or use without explicit permission.
- User Content: Users retain rights to their content but grant SubTracker a license to use it for service delivery.
- No Circumvention: Circumvention of technical protections is strictly prohibited.
- Third-Party Links
SubTracker may link to third-party websites. We are not responsible for their content or data practices.
- User Risk: External websites are used at the user’s own risk.
- No Liability: SubTracker disclaims responsibility for third-party content or privacy.
- Export Control Laws
Users are responsible for complying with all applicable export laws and sanctions.
- Sanctions Compliance
Users must not engage in transactions with sanctioned individuals or countries.
